By accessing or using MagicPlanner.ai ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service. These Terms constitute a legally binding agreement between you and MagicPlanner.ai regarding your use of our Disney World planning website.

Service Description

MagicPlanner.ai is a free planning tool for Walt Disney World visits. Our service includes:

• A crowd calendar with daily crowd-level predictions for all four Disney World theme parks
• Live attraction wait times, show times, and dining information, updated throughout the day
• Prediction accuracy reporting comparing our forecasts to measured wait times
• AI-assisted planning content and a question feature ("Ask MagicPlanner") powered by third-party artificial intelligence technology

The service is currently free and does not require an account. Some features (such as AI questions) are subject to fair-use rate limits. We may introduce optional paid features in the future; if we do, these Terms will be updated first.

Important: MagicPlanner.ai is not affiliated with, authorized by, or officially connected with The Walt Disney Company. We are an independent vacation planning tool.

User Obligations and Prohibited Uses

Acceptable Use

You agree to use MagicPlanner.ai only for legitimate vacation planning purposes. You will:

• Use the service for personal, non-commercial vacation planning
• Respect fair-use rate limits on AI features
• Comply with all applicable laws and regulations

Prohibited Activities

You agree NOT to:

• Use the service for commercial purposes or resale (including scraping or republishing our data or predictions) without written permission
• Attempt to reverse engineer, hack, or circumvent our systems or rate limits
• Use automated tools or bots to access the service at excessive volume
• Attempt to misuse AI features, including attempting to make them produce content unrelated to Disney World planning
• Violate any intellectual property rights
• Use the service to plan illegal activities

Data Usage and Privacy

Your privacy is important to us. Our data collection and usage practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points

• No account, name, email, or payment information is required or collected
• Saved trip dates live in your own browser, not on our servers
• Questions you ask the AI feature are processed to generate an answer and are not stored in our databases

Intellectual Property

Our Rights

MagicPlanner.ai, including its software, prediction models, design, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. Personal, non-commercial sharing of screenshots or links is welcome.

Disney Trademarks

All Disney parks, attractions, characters, and related trademarks are the exclusive property of The Walt Disney Company. We use these references solely for informational purposes in vacation planning.

Disclaimers and Limitations

Service Availability

• We strive for high availability but cannot guarantee uninterrupted service
• Scheduled maintenance may temporarily limit service availability
• We reserve the right to modify or discontinue features with reasonable notice

Predictions and AI-Generated Content

• Crowd levels and wait times are statistical predictions and estimates, not guarantees. Actual conditions will vary
• Some content is generated using artificial intelligence technology. AI systems can make mistakes, produce outdated or incorrect information, or misinterpret questions
• AI-generated answers are informational planning suggestions only and should not be your sole basis for travel decisions
• You should verify park hours, attraction availability, event dates, and policies with official Disney sources before your trip
• Park operations, hours, and policies may change without notice, and we are not responsible for changes to Disney operations that affect your plans

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MagicPlanner.ai is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages
• Our total liability shall not exceed $100 USD
• We are not responsible for third-party services, data inaccuracies, Disney operations, or AI-generated content errors
• We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
• No advice or information obtained from us shall create any warranty not expressly stated herein

Suspension of Access

Because the service is free and requires no account, there is nothing you need to cancel. Simply stop using the site. We may suspend or block access (for example, by IP address) for users who:

• Abuse rate limits or use the service at excessive automated volume
• Attempt to attack, disrupt, or misuse the service

Legal Provisions

Governing Law
